Filing a Personal Injury Claim
Personal injury law, also known as “tort law,” was designed to protect individuals in case they are injured or harmed because of another person’s negligent actions, or failure to act. In a successful personal injury case, the individual or entity that caused the injury compensates the victim who suffered the losses.
The vast majority of personal injury cases are settled outside of court. When we “settle” a case, it means that our client is agreeing to accept money in return for dropping their action against the person that injured them. Our client signs a release absolving the other side from any further liability.
A settlement can be made at any time during the lawsuit once it is filed, and this includes before a trial, or after a trial but before the jury reaches a verdict. We represent clients in an array of personal injury cases, including but not limited to:
- Car Accidents
- Truck Accidents
- Pedestrian Accidents
- Motorcycle Accidents
- Dog Bites
- Premises Liability Claims
- Product Liability Claims
- Medical Malpractice
- Wrongful Death
Why You Need a Good Lawyer
While victims can represent themselves in personal injury actions, this method is usually not recommended in the legal profession. It is important to remember that insurance companies are for-profit companies who are concentrated on their own bottom line. Even the friendliest insurance adjusters are working hard behind the scenes to devalue or deny claims.
Once you have a good personal injury attorney on board, your chances of receiving the compensation you deserve are far greater than if you decided to handle your own claim, and the difference can mean tens of thousands of dollars.
Every state has its own statute of limitations that govern the period during which you can file a personal injury lawsuit. Under §95.11 F.S., you have four years to file an action founded on negligence, and you have two years for a medical malpractice action, or within two years from the time the incident is discovered.
