Manslaughter Charges in Florida

Section 782 of the Florida Statutes defines manslaughter as the killing of a human being by the act, or culpable (worthy of being blamed) negligence of another without lawful justification. Under §782.07, manslaughter is a felony of the second degree, punishable by up to 15 years in prison, and up to $10,000 in fines.

Aggravated Manslaughter

When a person causes the death of an elderly or disabled person by culpable negligence under Section 825.102(3), he or she is guilty of aggravated manslaughter, a felony of the first degree, punishable by up to 30 years or life imprisonment and up to a $10,000 fine.

When a person causes death, through culpable negligence of a minor under the age of 18, he or she commits aggravated manslaughter of a child, a felony of the first degree, punishable by up to 30 years or life imprisonment and a maximum $10,000 fine.

It is a felony of the first degree when a person causes the death, through culpable negligence of an officer, firefighter, paramedic, or emergency medical technician while he or she is performing their duties within the course of their employment, also punishable by up to life imprisonment and a fine not to exceed $10,000.
