What Should You Do at a DUI Checkpoint?
It is sometimes possible to find out DUI checkpoint locations in advance. If you can avoid these places, do so. If you see a checkpoint in the distance while you are driving, do not make a turn to avoid it. Law enforcement will be looking for this type of behavior and assume it is an admission of guilt. If you find yourself at a DUI checkpoint, keep in mind the following:
- Stay calm. Be respectful to the police officer. Provide your ID and registration if asked. Do not make any sudden movements or reach for your pocket or glove box unless asked to do so. These kinds of movements can be interpreted by law enforcement as threatening. They may think you are trying to reach for a weapon.
- Don’t answer questions. While it is important to be as cooperative as possible, it is also very important to know your legal rights. This includes the right to refuse certain things like answering questions. You do not have to answer any questions asked by the police officer. In fact, you should respectfully to decline answering any and all questions as is your right. The right to remain silent is held by all.
- Don’t consent to a search of your vehicle. Additionally, if asked if your car can be searched, make it clear that you do not consent to a search. If asked to step out of your vehicle, do so, but be sure to lock your car behind you
- Make mental notes. Try and be as aware as possible as to what is going on at the checkpoint. What did the officer tell you to do? What kind of questions did they ask? You never know what details can be important later on.
